Terms of Service

1. Introduction

These Terms of Service govern the use of the Encompass and Encompass FX online platforms, educational programs, digital tools, and related support services developed and operated by C & K Moneyline (Pty) Ltd (hereinafter “CKM”).

Encompass and Encompass FX are web-based educational platforms accessible via secure login credentials provided upon confirmed enrolment.

By accessing or using this website or platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Role of Encompass and Authorized Distributors

CKM is the developer and platform provider of the Encompass and Encompass FX educational systems.

Certain products and programs may be marketed, sold, or distributed through authorized independent distributors or consultants.

Where a product is purchased through a distributor:

  • The purchase agreement is concluded between the client and the distributor.
  • Pricing, payment structures, financing arrangements, and sales-related representations are determined by the distributor.
  • The distributor operates independently and is not an employee of CKM unless expressly stated in writing.
  • CKM provides access to its Encompass educational platform and related tools subject to confirmed enrolment.

Any disputes relating to:

  • Sales conduct
  • Pricing
  • Financing terms
  • Representations made during consultations

must be addressed directly with the relevant distributor.

Nothing in these Terms creates an agency, partnership, or employment relationship between CKM or Encompass (products) and independent distributors.

3. Nature of Services

The Encompass and Encompass FX products provide:

  • Financial education
  • Market theory and structured training
  • Technical analysis education
  • Chart interpretation training
  • Coaching and learning support

Certain Encompass products may include simulation tools designed strictly for educational purposes.

Encompass FX is an educational program only and does not include live trading, simulation trading, trade execution, or fund management services.

Encompass does not:

  • Provide financial advice
  • Provide investment advice
  • Provide trading signals
  • Manage client funds
  • Execute trades on behalf of clients
  • Guarantee profits or returns

All trading and investment decisions remain the sole responsibility of the client.

4. Scope of Services

CKM offers multiple educational products and structured service packages.

Features, tools, inclusions, subscription periods, and access rights may vary depending on the product selected.

Where applicable, full details relating to:

  • Service duration
  • Access rights
  • Subscription structure
  • Product inclusions
  • Payment terms

Are communicated to the client at the time of enrolment or purchase through the relevant distributor or service arrangement.

Costing is provided prior to the conclusion of any purchase agreement.

5. Service Duration and Access

Certain products may operate on structured fixed-term access cycles, which may include (but are not limited to):

  • 24-month structured service cycles
  • 12-month access cycles structured as monthly instalments

Where a fixed-term structure applies, the specific duration and terms are governed by the client’s signed purchase or enrolment agreement with the relevant distributor or service provider.

CKM provides platform access in accordance with confirmed enrolment status.

Suspension of access may occur in the event of non-payment under the applicable purchase agreement.

Suspension of access does not constitute cancellation of the underlying agreement.

6. Cancellation of Fixed-Term Agreements

Where a client has entered into a fixed-term agreement governed by the Consumer Protection Act (CPA) of South Africa, cancellation rights are subject to Section 14 of the CPA.

Clients may cancel a fixed-term agreement by providing at least 20 business days written notice to the contracting party.

Where applicable, a reasonable cancellation fee may be charged in accordance with the CPA.

Cancellation fees may consider:

  • The remaining duration of the agreement
  • The value of services already provided
  • Administrative and operational costs
  • The nature of the service rendered
  • Industry standards and fairness principles

All cancellation requests must be directed at the contracting party under the relevant purchase agreement.

7. Renewal

Unless otherwise agreed in writing, fixed-term agreements may continue on a month-to-month basis after expiry of the initial term.

Termination of a month-to-month arrangement requires 20 business days written notice to the contracting party.

Nothing in these Terms limits any rights afforded under the Consumer Protection Act.

8. Risk Disclosure

Trading in financial markets, including equities, CFDs, and foreign exchange, involves significant risk.

Clients acknowledge that:

  • Financial markets are volatile
  • Loss of capital may occur
  • Past performance is not indicative of future results
  • Educational material does not constitute financial advice

Participation in Encompass products and programs does not guarantee financial outcomes.

Clients act entirely at their own discretion and risk when applying any educational material in live market environments.

9. Educational Purpose

All content, training sessions, webinars, materials, tools, and educational resources are provided strictly for educational purposes.

Nothing presented within any program constitutes:

  • Personal financial advice
  • Investment recommendations
  • Portfolio management guidance
  • A solicitation to trade

10. Intellectual Property

All software, content, training materials, indicators, documentation, branding, and proprietary systems remain the intellectual property of CKM.

Clients may not:

  • Copy
  • Redistribute
  • Resell
  • Reverse engineer
  • Share login credentials

Without prior written consent.

11. Limitation of Liability

To the fullest extent permitted by law, CKM shall not be liable for:

  • Trading losses
  • Loss of profits
  • Indirect or consequential damages
  • Market-related losses
  • Sales conduct of independent distributors
  • Financing arrangements entered into with third parties
  • Suspension of services due to non-payment
  • Technical interruptions beyond reasonable control

12. Platform Conduct and Review Policy

CKM reserves the right to moderate, remove, or respond to comments, reviews, or posts on its official platforms where such content:

  • Relates to matters outside the direct services provided by the Encompass products
  • Concerns independent distributor conduct not attributable to CKM or Encompass
  • Contains defamatory, false, or misleading statements
  • Violates applicable laws

Nothing in this clause restricts a consumer’s lawful rights to raise complaints through appropriate legal or regulatory channels

13. Amendments

CKM reserves the right to amend these Terms at any time.

Updated versions will be published on this website and will apply to future platform use.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes relating to platform access or these Terms shall be subject to the jurisdiction of South African courts.
